Substantial Increase with new fees at USPTO

The United States Patent and Trademark Office (USPTO) has announced that its fees will increase effective January 19, 2025. The official total costs for filing, search, examination, and issuance of design patents will increase by approximately 48%.

For each independent patent claim over three, a fee of $600 will be charged, representing a 25% increase. For each claim over 20, the fee will rise to $200, doubling the current amount.

The fee for the first Request for Continued Examination (RCE) will increase by 10% to $1,500. For the second and each subsequent RCE, the fee will increase by 43% to $2,860.

Applications filed six years after the earliest priority date (known as continuation-in-part applications) will incur a surcharge of $2,700. After nine years, the surcharge will be $4,000.

Tiered fees for Information Disclosure Statements (IDS) will be introduced, based on the number of disclosed items.

Maintenance fees will increase as follows: after 3.5 years, by 8% to $2,150; after 7.5 years, by 7% to $4,040; and after 11.5 years, by 8% to $8,280.
